Terms of Service

*Effective date: January 01, 2026*

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the services provided under the "Vanelton Media" brand, currently operated by VANELTON BERTOLDO ROCHA JUNIOR and LUCAS DE MORAIS MENDES, individuals, with administrative headquarters in Maceió, Alagoas, Brazil ("Company," "we," "us," or "Vanelton Media").

Note on legal structure. As of the effective date of these Terms, Vanelton Media has not been formally incorporated as a legal entity (no company registration/CNPJ has been obtained). The Services are provided directly by the individuals named above, who are personally and jointly liable, without limitation, for the obligations undertaken under these Terms, pursuant to Brazilian civil law applicable to unregistered business activity (Articles 966 and 986–990 of the Brazilian Civil Code). This section will be updated once formal incorporation is completed.

These Terms apply to all users of all products and services offered by the Company, including, but not limited to: Vanelton ID (global login service), Vanelton Console (developer dashboard), Vanelton AppHub (app/game store), Vanelton Connect, Volcam Studios (subsidiary game company), Vanelton Media Tools, Orbit WorkApps, Vanelton Labs (early access/experimental tools), Vanelton Open Labs (open-source tools), and any other current or future services (collectively, the "Services").

By accessing, using, or registering for any of the Services, you confirm that you have read, understood, and agreed to be bound by these Terms and the Privacy Policy (linked below). If you do not agree with any part of these Terms, you must not access or use the Services.

2. Definitions of Services and Key Terms

For the purpose of these Terms, the following definitions apply:

  • Company / Vanelton Media: Refers to VANELTON BERTOLDO ROCHA JUNIOR and LUCAS DE MORAIS MENDES, the individuals identified in Section 1 as currently responsible for operating the Vanelton Media brand and Services.
  • Services: Collectively refers to all platforms, applications, software, content, tools, apps, and games provided by Vanelton Media or its subsidiaries.
  • User: Any individual or entity that accesses or uses the Services.
  • User Content: Any data, information, text, graphics, photos, videos, or other materials uploaded, posted, or transmitted by the User to or through the Services.
  • Developer: A User who utilizes the Vanelton Console or related tools for creation, distribution, or commercialization of their products, including listing products on Vanelton AppHub.

3. Registration and User Account

3.1 Account Eligibility and Protection of Children and Adolescents

The Services are intended for a general audience, including developers and businesses. The minimum age to create an account and use the Services is 13 (thirteen) years old. This age requirement is a fundamental condition for engaging with our Services.

In line with Brazilian Law No. 15,211/2025 (the Digital Child and Adolescent Statute, popularly known as "ECA Digital" or "Lei Felca"), the Child and Adolescent Statute (Law No. 8,069/1990), and the Brazilian General Data Protection Law (LGPD, Law No. 13,709/2018, Art. 14), we apply the following measures:

a. Age verification. We use facial age verification to unlock access to content, products, or areas of the Services intended for users over 18 or rated as unsuitable for minors. Access to these areas and products remains locked until this verification is successfully completed; we do not rely solely on self-declared age at sign-up for this purpose.
b. Content separation. The Services are organized into distinct areas and products: one intended for a general audience (including eligible underage Users under this Section) and one intended exclusively for users over 18, access to which depends solely on the facial verification described in item (a).
c. Parental consent for users under 12. Personal data of Users under 12 (twelve) years of age will only be processed with the specific, highlighted consent of a parent or legal guardian, and such processing will be limited to what is strictly necessary to provide the Service, per Article 14 of the LGPD.
d. Default privacy settings. Accounts identified as belonging to minors will, by default, have more restrictive privacy and security settings.
e. Advertising. We do not direct behavioral or personalized advertising to Users identified as minors.
f. Parental supervision. We do not currently offer a parental control panel that lets a legal guardian link to a teenage User's account and remotely manage its settings. This feature is under evaluation for future versions of the Services.

Furthermore, if you are under the age of 18 (or the age of majority as legally defined in your specific jurisdiction), your engagement with and use of our Services necessitates the direct supervision and explicit consent of a parent or legal guardian. In such cases, the parent or legal guardian must also provide their affirmative agreement to be legally bound by these Terms.

If you are a parent or legal guardian of a User who is under the age of 18, you hereby unconditionally and irrevocably agree to these Terms, and you assume full and complete responsibility for any and all actions, omissions, or liabilities of such User in connection with their interaction with our Services.

Additionally, if you have been previously suspended or permanently removed from accessing or using any of our Services for any reason, you will not be permitted to use them again under any circumstances.

3.2 Account Security and Control (Vanelton ID)

The registration of a User account (Vanelton ID) may be a mandatory prerequisite for accessing some or all of our Services. You agree to:

a. Provide accurate, current, and complete information during the registration process and keep it updated.
b. Maintain the security and confidentiality of your password and login credentials.
c. Accept full responsibility for all activities that occur under your account, whether or not authorized by you.

Prohibited Sharing: The sharing of your account credentials with any other individual or organization is strictly prohibited. Furthermore, the use of a single Vanelton ID account by multiple individuals or organizations, especially for accessing solutions such as the developer panel, frameworks, and APIs, is strictly forbidden, subject to the business account exception below. Any violation may result in immediate suspension or permanent termination.

Business Account Exception:

a. Where a Service or product offers, as a feature, a business plan that allows each person involved (for example, each employee) to have their own individual account linked to that plan, the general rule of this Section applies: each person must use their own account and their own credentials, and sharing login credentials between them is prohibited.

b. Where a Service or product is also intended for businesses but does not offer, as a feature, a business plan with individual accounts for multiple employees, the business may share the credentials of a single Vanelton ID account among its employees, provided that access occurs within the business's own environment and equipment.

c. The Vanelton Media team may periodically conduct access reviews and checks to verify compliance with these rules. Any suspicious access or violation of these Terms identified during such reviews will result in termination of the account involved and a ban on the associated email address.

4. Rules of Conduct and Acceptable Use

You agree to use the Services in compliance with these Terms, any additional terms specific to individual Services, all applicable laws and regulations (especially Brazilian law), and the continuous exercise of common sense.

4.1 Commitment to Inclusivity, Safety, and Social Justice (The Vanelton Media Standard)

Vanelton Media is fundamentally committed to fostering an inclusive, safe, and just digital environment for all. We actively pay attention to social contexts and daily struggles faced by individuals, seeking to protect minorities and integrate these concerns into our Services. We uphold the principle of mutual respect and non-discrimination.

We are committed to maintaining an environment free of hate and harassment for all Users, regardless of age, gender, gender identity, sexual orientation, race, ethnicity, religion, disability, or any other characteristic protected by law.

4.2 Prohibited Conduct and Content Restrictions

These provisions apply to all content related to our Services, including, but not limited to, external communities, audiovisual content, and other public postings.

Prohibited activities include, but are not limited to:

a. Hate Speech and Discrimination: Posting, uploading, or transmitting any content that is discriminatory, hostile, or derogatory (collectively, "Hate Speech"). This includes, without limitation, language based on race, ethnicity, nationality, religion, gender, sexual orientation, gender identity, disability, or other characteristics protected by law.
b. Harassment and Intimidation: Harassment of any nature, including unsolicited sexual comments, unwanted advances, stalking, cyberbullying, or any form of intimidation, directed at any User, especially women, children, and adolescents, is strictly prohibited. Disrespectful, invasive, or unsolicited conversations, particularly of a sexual nature, constitute harassment.
c. Child Exploitation and Abuse: Exploitation, abuse, exposure to risk, or sexualization of children and adolescents. Any content violating this provision will be reported immediately to the appropriate legal and law enforcement authorities.
d. Illegal and Harmful Activity: Engaging in any illegal activity, promoting illegal acts, or linking our Services or brands to illegal activities.
e. Defamation and Derogatory Content: Creating or distributing content (in or outside the Services) that is defamatory or derogatory towards the Company, its Services, or other Users.
f. Technical Misconduct: Engaging in spamming, phishing, or distributing malware, viruses, or other harmful code; attempting to reverse engineer, decompile, or disassemble any aspect of the Services.
g. Impersonation and Misrepresentation: Impersonating any person or entity, or falsely representing your affiliation with any person or entity.

4.3 Commercial and Non-Commercial Use Policy

Certain products and Services, particularly those not specifically designated otherwise, are intended solely and exclusively for personal, non-commercial use. This includes, by default, all tools and services offered under the Vanelton Labs program, given their experimental, no-cost, and early access nature. Any form of use by, or on behalf of, any organization, company, or business entity for commercial purposes is strictly and unequivocally forbidden, except for the following specific products and Services which are expressly available for commercial use, subject to their respective terms and conditions:

a. Developer Platform: Includes all frameworks, Application Programming Interfaces (APIs), and technical solutions made accessible through the Vanelton Console panel.
b. Business Solutions: Distinct applications or WebApps specifically designed and offered by Vanelton Media for business use and commercial deployment.
c. Open Source (including Vanelton Open Labs): Any products or Services officially released under an open-source license, including those offered through Vanelton Open Labs (which are provided to incentivize study and broad access), are permitted for commercial use, subject to the terms of that specific open-source license.

4.4 Responsibility for External Communities and Content

Communities created for the use of our Services must comply with these guidelines. Communities that post hateful, illegal, or harassing content may result in the suspension of all associated User accounts, regardless of the User's direct involvement in the posting of such content.

4.5 Consequences of Violation

Violation of these provisions may result in sanctions, including the immediate and permanent suspension or termination of the User account, and/or the initiation of appropriate legal action.

The Company is exempt from any liability for damages caused by third parties to the personal lives of Users associated with the external communities mentioned in Section 4.4.

5. Intellectual Property Rights

5.1 Company Ownership

The Services, including all software, technology, designs, trademarks (such as "Vanelton ID," "Vanelton Console," and the "Vanelton Media" name/logo), and content, are the exclusive property of the Company and are protected by applicable intellectual property laws, to the extent such protection has been secured (see Section 5.1a below).

5.1a Note on trademark registration. Some names and logomarks referred to as "trademarks" in these Terms may not yet be formally registered with Brazil's National Institute of Industrial Property (INPI). Until registration is completed, protection is limited to what unregistered signs are afforded under general civil and unfair-competition law, which is narrower than registered trademark protection.

5.2 User Obligations Regarding Company IP

The User guarantees that, when utilizing the Services, they will not use the Company's name or the names/logomarks of our Services to present their own product as an original product of Vanelton Media without express authorization. The User may only use our names and/or logomarks in their projects for the sole purpose of attributing the use of our products or Services. Any unauthorized distribution of our Services is strictly prohibited.

6. User-Generated Content (UGC)

6.1 User Responsibility for Content

You are solely responsible for all User Content that you upload, post, or display on or through the Services. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize the Company to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all User Content.

6.2 General License Granted to the Company

To enable the operation and provision of the Services (including hosting, backup, display, format conversion, and technical support), the User grants to the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and display the User Content, to the extent strictly necessary to operate and maintain the Services. This license remains in effect while the Content stays on the Services, and for a reasonable additional period when necessary for backup, legal compliance, or archival purposes.

6.3 Promotional License for Content Listed on Vanelton AppHub

By publishing or listing a game, app, or other product ("Developer Content") on Vanelton AppHub, the Developer grants the Company a worldwide, non-exclusive, royalty-free license to display, reproduce, and use the Developer Content — including screenshots, trailers, descriptions, and other materials provided — as part of the storefront, editorial curation, featured placements, marketing campaigns, and other promotional initiatives of Vanelton AppHub and its catalog, without needing specific prior authorization for each individual use.

This promotional license remains in effect for as long as the Developer Content stays listed and available on Vanelton AppHub. The Developer may remove their Content from the platform at any time; once removed, the Company will stop using the Content in new promotional initiatives, though it may keep already-published promotional material in circulation (for example, social media posts already published) for a reasonable period until it is replaced or naturally taken down.

This promotional license does not transfer ownership of the Developer Content to the Company and does not prevent the Developer from distributing the same content on other platforms.

6.4 Content Moderation

Vanelton Media reserves the right, but is not obligated, to monitor, review, edit, or remove any User Content, at its sole discretion, for any reason, including violation of these Terms or lack of common sense.

7. Third-Party Links and Advertising

The Services may contain links to third-party websites, advertisers, services, or events that are not owned or controlled by Vanelton Media. The Company does not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website from the Services, you do so at your own risk.

8. Disclaimer and Limitation of Liability

8.1 Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Limitation of Liability

The Company shall not be held liable for damages caused to users or non-users of Vanelton Media resulting from the misuse of the Services or content generated by other users utilizing our tools.

Notwithstanding the foregoing, Vanelton Media guarantees its availability to actively combat and respond to any instance of lack of common sense or severe misconduct by users utilizing the Services, in accordance with Section 4.5 and Section 10.

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use, or alteration of your transmissions or content.

8.3 Non-Waivable Consumer Rights

Nothing in these Terms excludes or limits any right or guarantee that, under applicable Brazilian law — including the Consumer Protection Code (Law No. 8,078/1990) — cannot be waived or contractually limited.

9. Indemnification

You agree to defend, indemnify, and hold harmless Vanelton Media and its principals, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services, including any data or content transmitted or received by you; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights; or (iv) any damage or loss caused by your User Content.

10. Rescission (Termination)

10.1 Termination by User

The User may cancel or terminate their account at any time and for any reason by following the process within the relevant Service's interface. Upon termination, the User is allowed to create a new account subsequently.

10.2 Termination by Company

Where a User violates these Terms, misuses the Services, engages in fraudulent activity, or acts in a way we consider inconsistent with the spirit of these Terms (including a severe lack of common sense), Vanelton Media may suspend or terminate that User's access to the Services immediately and permanently, without prior notice, and without any refund of amounts already paid for the period in which the violation occurred.

In all other cases — where the Company chooses to discontinue a specific Service or end a User's access without any breach of these Terms on that User's part — we will make reasonable efforts to provide at least 15 (fifteen) days' prior notice and, where applicable, will refund on a pro-rata basis any paid, unused portion of the User's license for the remaining period.

11. Payments and Financial Transactions

11.1 Licensed Services

Certain of our Services are accessible exclusively through a paid license, which may be acquired either as a one-time purchase (granting perpetual or defined-period access) or via a recurring monthly subscription (providing continuous access during the term). Certain Services also offer the option of in-app purchases, which may include the acquisition of virtual items, digital credits, or other digital content.

11.2 Anti-Piracy and Unauthorized Use

The use of our Services on platforms or through channels not explicitly authorized by us, or by designated third parties, is strictly prohibited. Any unlawful or illicit use of these Services, including, but not limited to, attempts at reverse engineering our software, unauthorized circumvention of our licensing mechanisms, or the use of any software or tools capable of falsifying or manipulating valid licenses, is strictly forbidden and may result in immediate account termination, civil penalties, and legal action.

12. Refund Policy (7-Day Money-Back Guarantee and Service Disruption)

12.1 Right of Withdrawal and 7-Day Guarantee

For licensed Services that require payment, we guarantee the right of withdrawal set out in Article 49 of the Brazilian Consumer Protection Code: you may request cancellation of the purchase and a full refund within 7 (seven) calendar days of purchase confirmation, with no need to state a reason, since the purchase was made outside a physical place of business.

This right may not apply, or the refundable amount may be adjusted proportionally, where the digital Item or content purchased has already been substantially used, downloaded, or consumed by the User before the refund request — a condition that will be clearly disclosed before each purchase is confirmed, similar to the practice adopted by other digital stores.

Refund requests may be formally submitted through our designated email support channel. We reserve the right to restrict, for future purchases, access to the refund program for Users who show a demonstrated, recurring pattern of abusing this right (for example, systematically buying and refunding the same type of content after full use), without affecting refunds already granted in prior cases.

12.2 Refund Due to Service Discontinuation

In the event that Vanelton Media unilaterally discontinues a specific Service or shuts down servers operating in a particular region, resulting in material prejudice to a User, the Company will apply a refund for the affected licensed purchase, provided that the purchase was made within the last 60 (sixty) days prior to the date of service discontinuation.

13. Virtual Items and Digital Content

13.1 Limited License and No Real-World Value

Within our Services, we may make available various types of digital content, including, but not limited to, credits, digital currencies, or other virtual items ("Virtual Items"). You are granted a limited, non-transferable, and revocable license to use or access these Virtual Items exclusively within the confines of our Services.

You understand and acknowledge that while you may use terminology such as "acquire," "buy," or "earn" Virtual Items, you do not legally own these Virtual Items. Their presence in your account does not confer any proprietary right, title, or interest in them. The value attributed to these Virtual Items within our Services does not represent any real-world credit balance, monetary value, or equivalent. Any displayed "virtual currency" balance in your account serves solely as a measure of your limited license to use such Virtual Items within the Services.

13.2 Trading Prohibition

Users are strictly and unequivocally prohibited from engaging in any form of trading, selling, or otherwise commercially offering credits or virtual items obtained within our Services to any third party, whether for real-world currency, other virtual currencies, or any other form of consideration. Similarly, you are expressly forbidden from trading, selling, or transferring your user account itself.

13.3 Randomized Items ("Loot Boxes")

Certain Virtual Items may be offered through randomized mechanics ("Loot Boxes" or surprise items). Loot Boxes cannot be purchased directly with real-world money, or with virtual currency that is itself directly purchasable with real-world money; they can only be obtained using currency or credits that are not sold directly (for example, currency earned through normal use of the Services). All items obtainable through Loot Boxes are also made available for direct purchase in the store, at the corresponding price, with no need to rely on randomized mechanics.

14. Privacy Policy and Data Collection

Your use of the Services is also subject to our Privacy Policy, which explains in more detail how we collect, use, and disclose information about you.

Please read our Privacy Policy carefully: https://support.vaneltonmedia.com/privacy

In general terms, we process the following personal data, for the following purposes and legal bases, under the Brazilian General Data Protection Law (LGPD, Law No. 13,709/2018):

a. Account and registration data. We collect your email to create and authenticate your account (Vanelton ID), based on the necessity to perform the contract (LGPD, Art. 7, V).
b. Usage and activity data. We collect data on how you use the Services (for example, activity within apps and games distributed via Vanelton AppHub) to operate the Services, prevent fraud, and improve our user support, based on legitimate interest (LGPD, Art. 7, IX) and contract performance.
c. Payment data. To process payments, we share the information strictly necessary with our payment processor, Stripe, which may process this data outside Brazil, subject to the safeguards required under LGPD Articles 33–35 for international data transfers. We do not store full payment card data on our own servers.
d. Name and support. We use your email and, where provided, your name to administer your account and to improve support.
e. Optional data. Providing your full name and a profile photo is optional. You can use the Services without providing this data; it will only be processed if you choose to add it to your account, based on your consent (LGPD, Art. 7, I).

You may, at any time, request access to, correction, deletion, or portability of your personal data, or withdraw your consent, as well as obtain information about who we share it with, by contacting us at the email address listed in Section 17.

Note on Data: Vanelton Media processes the data described above for the proper utilization and improvement of its Services and tools. By accepting these Terms, you acknowledge and consent to the data practices described here and detailed in the Privacy Policy.

15. Governing Law and Dispute Resolution

15.1 Jurisdiction and Geographical Constraints

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions.

Right to Service Discontinuation: Vanelton Media reserves the right to terminate access to a region, cease offering a specific Service, or shut down servers operating within any geographical region at any time, for any reason, with or without notice or justification.

Geographical Restrictions: These Services are primarily provided and operated from within Brazil. Accessing them from outside the geographical boundaries of Brazil is undertaken entirely at your own risk and discretion. You bear the sole and exclusive responsibility for ensuring full compliance with all applicable local laws, rules, and regulations in your specific jurisdiction. We expressly reserve the right to establish and enforce additional eligibility requirements for the use of specific services, or to restrict or terminate access for residents of territories where local laws or regulatory requirements conflict with the operation of our Services.

Unsupported Jurisdictions: Due to operational constraints and incompatibility with our business model — including restrictions imposed by the international payment processors we depend on — Vanelton Media currently does not offer support or guarantee service access in the following countries/regions: Israel (active armed conflict zone, creating operational and user-support risk) and Russia, Qatar, and North Korea (jurisdictions whose regulatory or payment-processing regime is incompatible with our current business model). Users attempting to access the Services from these locations do so entirely at their own risk, and their accounts may be subject to immediate closure without prior notice. This list may be revised as these factors change.

15.2 Forum for Disputes

For disputes between Vanelton Media and Developers or business partners — relationships not governed by the Consumer Protection Code — the User and Vanelton Media elect the courts of Maceió, Alagoas, Brazil, as the forum.

For end Users acting as consumers, Article 101, I, of the Consumer Protection Code prevails, which guarantees the consumer the right to bring an action in the forum of their own domicile.

16. Changes to the Terms of Use

Vanelton Media reserves the right, at its sole discretion, to modify or replace these Terms at any time. When we update the Terms, we will update the "Last Updated" date at the top of this document. We will provide notice of material changes, such as by posting a notice on the Services or sending an email notification, prior to the new terms taking effect.

The effective date of these modified terms will be January 01, 2026, or a later date specified by the Company. Your continued use of the Services after the effective date of the new Terms constitutes your acceptance of the changes.
